Do the verification proceedings result in a suspension of placing a product on the market?
The verification does not automatically suspend placing a product on the market and does not order or results in an orderly withdrawal of the product from the market. The District Sanitary Inspector has the authorization to do that based on Article 32 of the Food and Nutrition Safety Act (Dz.U. 2006 r. nr 171, poz. 12250):
1. In the event of suspicion that the marketed foodstuff referred to in Art. 29 sec. 1, does not meet the specified requirements, the competent District or Border Sanitary Inspector decides to temporarily suspend placing of the aforementioned foodstuff on the market or to withdraw it from the market until the end of the procedure referred to in Art. 30 sec. 1.
2. The decision referred to in para. 1, applies when the aforementioned foodstuff meets the requirements shall also be taken when it is found that the product covered by the notification satisfies the requirements of a medicinal product or a medical device.
3. In case of a decision referred to in sec. 2, District Sanitary Inspector, through the Provincial Sanitary Inspector, notifies the competent provincial Pharmaceutical Inspector by sending a copy of the issued decision.
