Do I have to wait for GIS’s response to the notification?
The Chief Sanitary Inspectorate (GIS) is according to the Food and Nutrition Safety Act. This administrative authority needs to be notified about the initial placement of a dietary supplement on the Polish market. Notification is obligatory, and failure to comply with this obligation will result in legal sanctions. The notification procedure is described in Article 29 of the Act above:
• Initial placement on the Polish market of dietary supplement requires a notification.
• Notification is filed via an online form signed with an electronic signature (also by ePUAP) or via its printed version send to GIS.
• The notification shall include such information as name o a product and its producer, exact formulation of the product, its form and form of its marking, and legal qualification.
Dietary supplements are not medicinal products, and therefore their registration is not required, nor any permit is necessary. Therefore, there is no need to wait for GIS’s response to the notification. However, GIS can instigate a verification or question the legality of a supplement under the Polish or European Law.
